1. Agreement to Terms
These Terms of Use (the “Terms”) govern your access to and use of the TrailPix websites, apps, software, and services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What TrailPix Is (and Isn’t)
TrailPix is an AI‑assisted travel planning and storytelling tool intended for idea generation and personal organization. TrailPix is not a booking site, travel agency, navigation provider, or a source of professional advice. Any routes, times, hours, or recommendations are informational only and may be inaccurate.
3. AI Outputs and Reliability
- AI assistance. Portions of the Service are powered by machine‑learning models. Outputs may be inaccurate, incomplete, misleading, unsafe, biased, or offensive.
- No reliance. You will not rely on AI outputs as the sole source of truth. You are solely responsible for verifying all information before acting.
- No professional advice. The Service does not provide legal, medical, financial, safety, or other professional advice.
4. Eligibility; Your Account
You must be at least 16 years old (or the age of digital consent in your region, if higher) to use the Service. Keep your credentials confidential and promptly notify us of any unauthorized use. You are responsible for activity that occurs under your account.
5. Acceptable Use
You agree not to: (a) violate laws; (b) infringe others’ rights; (c) upload malware or harmful content; (d) attempt to access non‑public areas; (e) interfere with the Service; (f) use the Service to generate misinformation, spam, or unlawful content; (g) reverse engineer or scrape except as permitted by law; or (h) circumvent usage limits.
6. Your Content; Licenses
- Ownership. You retain ownership of content you submit ("User Content").
- License to TrailPix. You grant TrailPix a worldwide, non‑exclusive, royalty‑free license to host, process, reproduce, translate, adapt, and display User Content to operate, maintain, protect, and improve the Service, and to create non‑identifying aggregated or de‑identified insights.
- Feedback. If you provide feedback or suggestions, you grant TrailPix a perpetual, irrevocable, royalty‑free license to use them without restriction or compensation.
7. Privacy and Data
- Privacy Policy. Our data practices are described in our Privacy Policy, which is part of these Terms.
- Sensitive data. Do not upload special‑category or highly sensitive personal data unless the Service explicitly requests it and provides appropriate controls.
- Security. We use commercially reasonable safeguards, but no service is 100% secure. You use the Service at your own risk and should maintain your own backups.
8. Third‑Party Services and Content
The Service may display or link to third‑party services (e.g., maps, POI databases, AI providers). TrailPix does not control and is not responsible for third‑party services. Their terms and privacy policies apply.
9. Subscriptions, Trials, and Billing
Certain features may require payment. Prices and terms will be shown at checkout. Subscriptions renew automatically unless canceled as described at purchase. Except where required by law or expressly stated, fees are non‑refundable. App‑store purchases are governed by the store’s terms.
10. Beta and Experimental Features
We may offer features labeled beta, preview, or experimental. Such features may be changed, suspended, or discontinued at any time and are provided as is with no warranties and no liability to the maximum extent permitted by law.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE (INCLUDING ALL AI‑GENERATED OUTPUTS) IS PROVIDED “AS IS” AND “AS AVAILABLE.” TRAILPIX AND ITS AFFILIATES, SUPPLIERS, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, NON‑INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR‑FREE, SECURE, OR UNINTERRUPTED, OR THAT CONTENT WILL BE CURRENT OR COMPLETE.
12. Limitation of Liability (Consumer)
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAILPIX AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, GOODWILL, OR SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF TRAILPIX FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TRAILPIX FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $100. Some jurisdictions do not allow certain disclaimers or limits; in those cases, the above applies only to the extent permitted by law.
13. Indemnification
You will defend, indemnify, and hold harmless TrailPix and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of law or third‑party rights.
14. Suspension and Termination
We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms, pose a risk, or to comply with law. You may stop using the Service at any time. Sections that by their nature should survive will survive termination (including 6–20).
15. Dispute Resolution; Arbitration; Class‑Action Waiver (US‑only)
If you reside in the United States: Except where prohibited by law, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis. Class and representative actions are not permitted. You may opt out of arbitration within 30 days of accepting these Terms by emailing contact@trailpix.ai with your name, the email associated with your account, and a clear statement that you opt out of arbitration.

We may modify the Service and these Terms from time to time. Material changes will be indicated by an updated “Effective date” and, where appropriate, additional notice. Your continued use after changes take effect constitutes acceptance.
18. Export and Sanctions Compliance
You may not use the Service if you are located in, or are a resident of, any country or region subject to comprehensive sanctions, or if you are a person or entity on a restricted list. You agree to comply with applicable export control and sanctions laws.
19. Miscellaneous
These Terms are the entire agreement between you and TrailPix regarding the Service. If any provision is unenforceable, the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or asset sale.
